I think we are on the same lines. It appears to me obvious that they are not being 'fair' with their numbers and so as with all the other matters and letters i have been writing this is just another area. FOS will have to write to me and state Firstplus have refused to supply the information requested, so this will be added to the whole case folder that i have been building.

I have sar'd them,they didnt give me anything other than statements, which i used for spreadsheets and graphs. But because of how they have changed our account in 2007 there is no breakdown of payments so i cannot see the amount they are charging in interest. In regards to other SAR info, I know that i have spoken to them, i have written to them, they have cashed payements i have made to them and applied them nine months later so it looks like i have been in arrears for almost a year, they have said that a cheque i sent them couldnt be cashed tho i did not hear this from the bank and i can see the money available on the statement, and strangley was able to pay by debit card. The list goes on ....... but no sign of this info when requested.

All i hope is that if they continue to treat us all unfairly one of the 'consumer' financial institutions will finally give in.

Many thanks for your help Neil. i have already done the spreadsheets based on early statements from FirstPlus and guesswork. (Incl graphs) However, i have asked for transparancy from FirstPlus based on the following;

-The information originally (2003) given in regards to the monthly PPI amount and the refund(2009) do not tally.

-FirstPlus changed my agreement with them in 2007 (without my knowledge until 2011) to show that each monthly payment is coming off the capital and the interest amount is held separately so when i see statements i can only see decreasing capital and then one number at the bottom of the statement that represents my interest outstanding.

I am sure that i could work through the numbers, but as i do with my main mortage i can see the breakdown clearly each month so i expect to have the same transparancy with this loan. FirstPlus advise FOS that they can't show the numbers because it is worked out by software. But i work within finance and software and a breakdown of an account is not difficult, if they won't supply it then i believe that there is another issue that needs investigation. If they refuse FOS for a second time, I will work out the numbers based on FirstPlus paperwork and my knowledge and provide them to the ombudsman who apparantly will look at the case file. I am currently dumbfounded that FOS cannot force them to supply evidence that confirms that they are dealing with the accounts fairly, i have never had a good reason to trust them. If we find that we are all out of sink by £30, times that by 50,000 customers that is £1.5m.

Sorry to go on,but this company have absorbed all waking hours since 2005 there is so much to say!

Thanks for the spreadsheet. Is that what FirstPlus supplied you with or is it something that you have worked out and which corresponds with any balance FirstPlus have supplied?

How do you know how to breakdown the 'capital' ? Which amount was for acutal loan capital and which is for PPI capital?

I felt that FirstPlus should have broken this down as a clear summary to us when we received our PPI refund for transparancy purposes. As they refuse to do this to us directly and to the FOS, this makes me more inclined to believe that FirstPlus have not refunded this fairly. If they continue to refuse to supply this information it would be added to our ongoing case for unenforceability for this loan.

Please be assured Halifax 71 that we have been chasing and writing to FirstPlus since 2005, we have not given up the fight and continue to chase them on a weekly basis.

This site is a great focus for them to see that they will be having a fight on there hands.

Thanks for response, though not sure i understand. If FP say i had this amount of interest added to the account on a daily basis based on PPI as well, then i must have been paying the interest at the end of each month. Because of my problem understanding how FP have reached these summary numbers I asked them for a complete breakdown,but they have refused to supply me and the FOS this information, so again it makes me smell a rat.

FP say,which may be what you are saying, that this was a number applied to the account,but not actually paid so it is non refundable.

I have asked Firstplus to breakdown every single payment we have made into capital,PPI and interest. They ignored all correspondence. I then asked FOS to get the information for me (since 2009) and as of yesterday and a phone call i had with FOS, FP refused FOS first request to do this.FOS said they will ask again but do not expect FP to comply. He asked me if i wanted to escalate the matter to the ombudsman (whose that, i thought i was speaking to them) and I said yes. FOS said that it could take a further 18 months.

My inital request was to enable me to work how FP got to the PPI numbers which we are disputing, but i am in the same position as you,i cannot work out how they get to their numbers.

FP told FOS that they work out their numbers out by using a piece of software!? dont we all, but we still know how it all breaks down. The information that FP did give to FOS about our account was on the basis that it was not passed on to us. FOS say FP said this because it contained other peoples info. But why are they given information deemed to be secret to FOS about us? I told FOS that i will continue to dispute the PPI refund until FP give a full breakdown of the PPI summary.

In the meantime i have got FP to confirm interest rates applied to our account throughout the period of the loan

Perhaps you guys can help - been chasing PPI refund since 2009, FOS were involved and this was the response we had from FirstPLus (Nov 2009)

INTEREST ACCURED TO DATE (LOAN ADVANCE & PPI PREMIUM) £27059.06
INTEREST ACCURED TO DATE ON LOAN ADVANCE ONLY £21735.93
DIFFERENCE = £ 5323.13
PPI PREMIUM = £12073.57
TOTAL APPLIED TO REDUCE LOAN BALANCE = 317396.70

TOTAL REPAYMENTS MADE TO DATE (LOAN ADVANCE&PPI) £44310.56
TOTAL REPAYMENTS MADE TO DATE ON LOAN ADVANCE £35593.67
DIFFERENCE IN PAYMENTS £ 8716.89

8% INTEREST ON PAYMENTS £ 2321.67

In 2009 we received the £8716.89 + £2321.67 back, but we have been chasing a refund on the £5323.13 ever since. Are we right to be chasing this? FOS as of yesterday have sided with First Plus and say this was not something we actually paid. I beg to differ if we are paying interest on a daily basis. Advice ASAP if poss want to fax back to FOS before they refer the case further as requested by us but will take 18 months.

Heather created a new topic Amended BFP Contract in the forums.
Following one of our recent deluge of letters to BFP trying to get to a clear and concise breakdown of payments made since the loan and PPI began (who am i kidding). After two years asking the same question BFP have now responded by saying
'BFP has suspended the interest on the account since 2007 and since then have not paid interest on your monthly payment, instead of this the suspended interest has been accuring separately hence the amount totalling £19699, this is just the same as the interest payable on your contractual monthly payment except as your interest has been suspended it is one lump sum.'
The go on to say that this is in our favour as we would have paid less interest (highly unlikely), and they justify doing this because we had been making late payments due to redundancy which we told them about.

Anyone else had this sort of this letter?

In October 2010 we were also in dispute with BFP and Evershed (clarity). We had an arrangement for paying back arrears, however, court documents were issued for repossession anyway. BFP would not speak/correspond with us. We phoned the Financial Ombudsman to complain about the inconsistant processes with BFP/Evershed. The same day the FOS issued a letter to BFP and issued us with a complaint reference number which we gave to the court along with our defence. The court case was cancelled, Evershed apologised for their 'error in this matter'. BFP want the case file held over for a year, but again we have complained to the FOS which was copied to BFP.

I would add a call to the FOS, may also provide another delay, and also another complaint about BFP.

As i said a couple of weeks ago, we too have written to MPs, OFT and FOS ( we have currently two complaints outstanding with FOS). Yesterday i emailed the Daily Mail as earlier this year they proclaimed victory on behalf of the pensioners who were missold savings plans by Barlcays/Bob Diamond. We asked them to take on a new campaign on behalf of second charge mortgages mis-sold by Barclays/Bob Diamond.Perhaps a few more people could also email the Daily Mail and try and get the newspaper to support the campaign. I understand what you mean as there is not a lot of evidence on this blog that supports the cause. If it is any help, even tho i dont write on here (well once), we have got two complaints about BFP with FOS, have already written to OFT Nov 10, also written to all party leaders, newspapers and Financial Services Secretary, again all Nov 10. Have since put together more documentation to ask FOS to deem agreement unenforceable, and am currently looking for a solicitor (dont want to write much on this bit incase of spies in the camp!). It could be, as with us, that FPC members are working in the background, and will hopefully share if they find any sort of success. The fact that this site is here helps all those involved know that they are not alone. We started writing to BFP before we found this site , and since we found it have used it many times to gather info, sign petitions and write emails as requested. Next time we will email to confirm any requests FPC have been done so you know that another FPC member is listening. Many thanks for being here.
