Firstplus - A New Avoidance - Data Protection Act

Many of our members have been requesting access to data from BARCLAYS FIRSTPLUS may be confronted with a new approach whereas Barclays Firstplus are requesting Dates and Times of calls made and received by them.  The members claim that FIRSTPLUS are attempting to use Section 7.3 (A data controller is not obliged to comply with a request under this section unless he is supplied with such information as he may reasonably require in order to satisfy himself as to the identity of the person making the request and to locate the information which that person seeks.)

Barclays FIRSTPLUS has spent millions in recent years on its Customer Relationship Management Systems and also it Complaints Logging System, for those who have had Data Protection Subject Access Requests in the Past, you will not have had to supply all this impossible information as FIRSTPLUS have simply cross-referenced its data to retrieve the details of calls.  It is also clearly evident that the calls are linked to individuals, therefore it is therefore easy to assume that this new approach is a way in which to attempt to avoid liability and compliance.

We therefore suggest that you challenge these request, should they fail to provide you with the calls, we will happily provide evidence that you can take to the ICO and the courts that categorically prove that they have supplied the information to others in the past and that their systems are more than capable of finding this data without the need for time and dates.
I suggest that any issue with FIRSTPLUS and its non-compliance of the data protection act should be directed without delay to the Information Commissioners Office.  We will happily assist with such a complaint so as to ensure that it is addressed.  We are aware of hundreds of complaints that have gone forward in the past 6 months, and hopefully action will be taken shortly.
